FBAs and BIPs are confusing to many practitioners because the IDEA's regulations contain unclear mandates on when an FBA must be conducted and when a BIP is required. This confusion often leads to districts developing plans on the fly. This presentation will clarify when an FBA and/or a BIP "must" be developed and when they are advisable. Most importantly, attorney Gil Middlebrooks will explain how to develop and conduct FBAs and how to develop BIPs that are legally defensible and academically sound.
