The Occupational Safety and Health Administration serves many functions to ensure safe and healthful working conditions. However, at its core, OSHA is an enforcement body tasked with inspecting, regulating and prosecuting violations of the Occupational Safety and Health Act of 1970. Despite every effort to ensure the safety of workers, employers will likely be subject to an OSHA inspection at one time or another. When that inspection occurs, employers must understand the rights afforded to the employer, the employees and the administration. Employers must also understand, and comply with, the duties placed upon the employer by the OSH Act during any OSHA inspection. In this session, you’ll learn about the procedures related to an OSHA inspection, the duties and legal ramifications of the OSHA interview process during an inspection, the nature of document production to the administration, and the strategies employers need to formulate and implement a defense to alleged violations.
