e-POSTER: Sometimes Windfarm Construction Doesn’t Go As Planned – How To Mitigate Disputes When Problems Arise

This presentation will focus on how to mitigate disputes arising from increased costs, change orders, and schedule delays on windfarm construction projects. There are a number of common issues that tend to surface when windfarm construction goes awry. Some of those issues include late infrastructure and foundation completion, late delivery of equipment, damaged equipment, weather impacts including high winds not allowing construction cranes to make lifts, and resequencing of work. The presentation will be neutral in terms of contractor v. developer/owner issues. We will discuss the potential damages issues faced by each side. Part of the presentation will be focused on select contract provisions (e.g., liquidated damage clauses), and some pitfalls we have seen in how these clauses are worded in the contracts and interpreted by the different parties involved. We will wrap up with some lessons learned from past windfarm projects that experienced these types of issues.
