Recent tragic events place schools under a legal and political microscope in how they respond to allegations of bullying, threats made by students, and the evaluation of whether a student’s mental health poses a risk to school safety. Those issues are heightened when the students have a disabling condition under either Section 504 or the IDEA. Add in legal issues with disproportionate discipline and the school-to-prison pipeline, and you have endless scenarios, all of which may require different responses from schools and school attorneys. This session will examine recent litigation centering around these issues and provide practical advice on how to respond when a student with a disability has been bullied on social media platforms away from school, how schools should respond when the bully is a student with a disability, how to respond to threats at school, and the proper steps when the actions implicate criminal behavior.
