S1 | FAPE When Nondisabled Students and Their Parents Won't Cooperate (Room Osceola D)

The school is responsible for determining and providing appropriate services but does not always have complete control of the school environment or the reactions of other students and their parents to services and accommodations required for students with disabilities. Unfortunately, sometimes other parents see unfair advantage rather than FAPE, and sometimes schools don’t improve the situation by serving students inappropriately or overly restricting the choices of others.  Attorney Dave Richards will review cases where nondisabled students and their parents oppose the IEPs or 504 plans of other students, including the refusal to cooperate with school limits on peanuts and other items necessary to protect students with disabilities. He’ll look at what schools can do, the power of nondisabled students and parents to frustrate implementation of plans, and how schools can craft and implement plans to address concerns.
