Special educators must comply with the privacy requirements of the Family Educational Rights and Privacy Act with respect to student records. Attorney Jose Martín will address how advances in technology have raised new questions and challenges with respect to records, including the use of staff emails regarding students, security video monitoring, text messages, and electronic maintenance of records. In addition, the session will cover responding to records subpoenas, records of school law enforcement units, dealing with requests to have records amended, adult students with involved parents, the additional records requirements in the IDEA regulations, and the process for destruction of records, among other topics.
