The words written (or not written) in an IEP can mean the difference between winning or losing a due process hearing and/or resolving a dispute. The IDEA provides districts some flexibility in documenting the IEP meeting. Much of the documentation requirements and prohibitions rely on state law, case law, OSEP’s interpretations, and district discretion. Attorney Dianna Bowen will discuss recent decisions and interpretations regarding IEP documentation and provide best practices for how, what, and when to document. She will identify common mistakes that teams make and how to avoid them. Through actual scenarios, you will have the opportunity to practice creating clear and legally compliant IEP documentation for any situation. This is a Fundamental Session.
