Most educators know that child find requires them to seek permission to evaluate any child for possible special education eligibility when the district has reason to suspect that the child may qualify under the IDEA or Section 504. In practice, however, educators struggle with implementing this concept. Attorney Bobby Truhe will outline school districts' legal obligation to effectively implement child find and will review a variety of cases that illustrate schools’ child find obligations. From “No, she’s really smart, she just refuses to come to school because she’s anxious” to “No, the parents revoked consent 5 years ago, so we are off the hook,” Bobby will shed light on the ways schools can get into legal trouble in both expected and unexpected ways. This is a Fundamental Session.
