This presentation will be an advanced session on the evolving legal challenges that can be asserted against OIG, CMS, and commercial payor statistical sampling processes and extrapolated overpayments. Attendees will learn the bodies of law and specific challenges that are increasing successful in invalidating improper and abusive sampling and extrapolation process used by auditors. Attendees will learn how to identify key issues and prepare to assert such challenges in the various appeals processes. Attendees will also learn techniques of how to properly apply sampling and extrapolation for internal reviews and self-auditing.
