S04 What Counsel and Witnesses Do That Drive Arbitrators Nuts! (Room Palos Verdes 6)

This session will highlight the role of the arbitrator and what arbitrators expect (and don't expect) from counsel and witnesses during the arbitration process and at the evidentiary hearing. Leading arbitrators will describe how certain actions, decisions, or judgments can produce unwanted or unintentional results in written Orders and ultimately, the Award.

Upon completion of this session, participants will be able to:
  • Determine if you really want your arbitrator to just "figure it out". How insufficient focus on causation and damages may lead to an unexpected adverse decision.
  • Understand how to anticipate and avoid time-wasting non-substantive evidentiary objections.
  • Gain an understanding productive case development through effective examination and cross-examination of witnesses.
