This session will discuss the issues and strategies when contractors (and particularly design-build and EPC contractors) are forced to fight on several fronts of a construction project, including simultaneous disputes with the project owner, design consultants, subcontractors, and large equipment providers.
Upon completion of this session, participants will be able to:
- Understand how conflicts with multiple project participants can arise between the contractor and its subcontractors and consultants and the owner, and how best to minimize financial and schedule problems.
- Understand how the contractor can avoid problems during the contract negotiation phase and how to best draft and handle project records and communications during construction to avoid potential conflicting positions.
- Understand dispute resolution procedures for best handling multiple party disputes. This includes early neutral evaluations and other methods to minimize financial and schedule risk to the contractor.
